Why Building Permits Often Hinge on a Land Survey

A permit office doesn’t care how confident you are about your property lines. They care about proof.

That’s the part a lot of homeowners miss when they submit plans for a deck, a fence, or a new addition. The city isn’t asking “does this look right?” They’re asking “can you show me exactly where your land starts and stops?” Without a land survey, that question usually goes unanswered, and the permit sits in a pile marked incomplete.

This happens more often than people expect. A homeowner measures from an old fence post. A contractor eyeballs the yard. Someone assumes the property line matches what’s on a tax map. None of that holds up once a permit reviewer starts checking the file.

What Building Departments Actually Check For Before Stamping a Permit

Permit reviewers aren’t just glancing at a floor plan. They’re comparing your proposed structure against the legal shape of your lot.

Here’s what they typically look for:

  • The exact boundary lines of the parcel, pulled from recorded survey data
  • Buffer zones required by local code
  • Whether the structure sits fully inside the buildable area
  • A match between the submitted site plan and the actual recorded lot lines

A plot plan drawn by hand, or copied from an old listing photo, doesn’t carry legal weight. A licensed surveyor’s stamped drawing does. Reviewers know the difference right away, and they treat an unstamped drawing as a guess, not a fact.

This is why permit staff ask for a survey before they’ll even schedule an inspection. They’re not difficult. They’re following a process that protects the city from approving something that later turns out to sit on the wrong side of a line.

Setback Compliance: The Permit Requirement Most People Don’t See Coming

Setbacks are the invisible lines nobody thinks about until a permit gets denied because of one.

A setback is the required gap between a structure and the property line, a road, or a right-of-way. Every city sets its own numbers. A shed might need ten feet from the back line. A garage addition might need twenty feet from the front.

The problem is, most people can’t measure a setback with any real accuracy on their own. Fences move over the years. Old markers rot or get buried under new landscaping. A homeowner might think their yard is thirty feet deep when it’s actually twenty-six.

A survey fixes that guesswork. It pins down the real corners of the lot, then measures out from there to confirm the new structure clears every required distance. If it doesn’t, you find out before pouring concrete, not after.

Skipping this step is one of the fastest ways to get a permit bounced back for revision. It also explains why some additions get built a few feet smaller than the homeowner first planned. The survey showed the setback wouldn’t allow the bigger version.

Utility and Easement Clearance: A Quiet Reason Permits Get Held Up

Easements rarely show up on a homeowner’s radar until a permit gets stuck.

An easement is a legal right for someone else, often a utility company or a neighboring property, to use part of your land for a specific purpose. Buried power lines, drainage pipes, shared driveways, and access roads all commonly sit inside recorded easements.

A land survey pulls this information straight from the county record and plots it on the lot. That matters, because building over or too close to an easement can trigger a permit hold, a required redesign, or in some cases a forced removal of the structure after it’s built.

Permit reviewers check for easement conflicts as a standard part of the file review. If a survey shows a proposed garage sitting on top of a drainage easement, the reviewer will flag it before approval, not after the foundation goes in.

This is one of the quieter reasons to permit stall. Nobody mentions it at the counter. The reviewer just marks the application incomplete and waits for updated plans that clear the conflict.

Grading and Drainage Verification Tied to Permit Sign-Off

Water has to go somewhere. Permit offices spend real time making sure new construction doesn’t send it somewhere it shouldn’t.

A survey with elevation data shows how the land currently slopes and drains. That information tells the reviewer whether a new structure, driveway, or addition will change water flow onto a neighbor’s yard or into a storm system that wasn’t built to handle it.

Local grading and stormwater rules exist because one poorly placed addition can flood a neighbor’s basement for years. Permit staff use survey elevation points to confirm the project keeps water moving the way it’s supposed to.

Without this data, a reviewer has no way to check a claim like “it won’t affect drainage.” With it, the review turns into a simple comparison: does the proposed grading match what local code allows?

What Happens When a Permit Application Skips the Survey

Some homeowners try to submit without a survey to save time or money. It rarely works out that way.

Here’s what tends to happen instead:

  • The application gets marked incomplete and sent back
  • The project timeline stretches by weeks while a survey gets ordered
  • A contractor starts digging based on a guess, then has to stop mid-project when the city flags a line dispute
  • A structure gets built too close to a boundary or an easement, forcing a costly redesign or a partial teardown

That last outcome is the expensive one. Tearing out a deck that was framed a few feet too close to the property line costs far more than the survey would have. Same story with a garage that clips into a utility easement.

Permit offices aren’t slowing projects down for no reason. They’re working from one plain fact: a survey is the only document that shows the real, legal shape of a piece of land. Everything else is an estimate.
